Hosting / Platform (Wix)
We use Wix (Wix.com Ltd., Israel). Wix processes server logs, security/performance data and cookies on our behalf. Processing may occur in the EU, Israel and other third countries. Transfers rely on an EU adequacy decision (Israel) and/or EU Standard Contractual Clauses (SCCs).
TLS/SSL
Our site is accessible via HTTPS; TLS/SSL is provided by Wix.

Payments & tax calculation
Payments are processed by Stripe (Stripe Payments Europe/Stripe, Inc.). We receive payment confirmation and bookkeeping data only. We also use Avalara (Avalara Holdings, Inc. / Avalara Europe Ltd.) for VAT/tax calculation and compliance. International transfers (esp. to the US) rely on EU SCCs.

Contacting us
If you contact us (email, form, phone), we process your data to handle the request (Art. 6(1)(b/f) GDPR) and retain it as required by law.
Newsletter (if used)
Double-opt-in; unsubscribe anytime via link. Service provider: [Wix Email Marketing / Mailchimp / Brevo – please specify]. Tracking (opens/clicks) only if enabled; this section will be updated once configured.
Web analytics & marketing (if used)
If we use analytics/marketing tools (e.g., Google Analytics/Ads, Meta Pixel, or Wix integrations), we do so only with your consent via our cookie banner (Art. 6(1)(a) GDPR; ePrivacy/TTDSG). We link to Facebook, Instagram and LinkedIn. No data is transmitted to these providers until you click a link. When you visit their sites, they process your data under their own responsibility. If we later add plugins/embeds, we will update this notice.

3)    TERMS & WITHDRAWAL

1.    Scope of application
These Terms and Conditions apply to contracts between SwingUp Coaching Ltd. and customers worldwide, concluded via www.su-coach.com or through individual offers.
Digital products (e.g., PDF guides, journals, checklists) are provided for download after payment.

2. SwingUp Coaching Ltd. offers coaching, mentoring, consulting and digital products. The scope and content of each service are defined in the respective service description or individual offer. Digital products are provided electronically; coaching sessions take place online or in person by agreement.
3.    Prices & payment
All prices are stated in EUR. The prices shown in the respective offer apply, including the taxes indicated. Payment is made using the available payment methods or by invoice in accordance with the agreed payment terms.
4.    Conclusion of contract
The presentation of our services on the website is non-binding. A contract is concluded upon acceptance of an individual offer or confirmation of an online order. Payment terms are specified in the respective offer or ordering process.
5.    Right of withdrawal (consumers)

For distance contracts, consumers generally have a statutory right of withdrawal within 14 days from the conclusion of the contract, where provided by applicable law.

Coaching Packages: Bookings are binding for the entire package. Services normally begin after the statutory withdrawal period has expired. After this period, there is no general right to cancel free of charge or receive a partial refund for unused sessions. Mandatory statutory rights remain unaffected.

If coaching begins during the withdrawal period at the consumer's express request, compensation for services already provided may be payable in the event of withdrawal, subject to statutory requirements

6.    Digital Content
For digital downloads, the right of withdrawal may expire once the content is made available, provided that the legally required express consent, acknowledgement of the loss of the withdrawal right, and contract confirmation have been obtained.
7.    Liability
Unlimited liability for intent and gross negligence and for injury to life, body or health. Otherwise, for slight negligence only for essential contractual duties (cardinal duties); in that case liability is limited to foreseeable, typical damage. Product liability remains unaffected. Coaching is not medical/psychological treatment.
8.    Copyright / usage rights
For digital content you receive a simple, non-transferable license for private use. Redistribution/publication is prohibited unless expressly permitted.

9.    Governing law, venueCyprus law applies. Mandatory consumer protection provisions of the country in which consumers have their habitual residence remain unaffected. The statutory rules on jurisdiction apply.

10.    Consumer dispute resolution 

SwingUp Coaching Ltd. does not currently participate voluntarily in proceedings before a consumer dispute resolution body. Mandatory statutory information and participation obligations remain unaffected.
11.  Appointment Cancellations and Rescheduling

Rescheduling appointments is generally free of charge. If an appointment within a coaching package is cancelled or rescheduled less than 24 hours before its start for the second time, the affected session may be considered used. The same applies to failure to attend without notice. Statutory rights and circumstances beyond the client's control remain unaffected.
